Last Updated: February 25, 2026 Effective Date: February 25, 2026
1. Commitment to Copyright Protection
Reservita Inc. ("Caletan," "we," "us," or "our") respects the intellectual property rights of others and expects users of the Caletan platform to do the same. We comply with the Digital Millennium Copyright Act of 1998 (17 U.S.C. Section 512) ("DMCA") and respond to clear notices of alleged copyright infringement.
This policy is part of our Terms of Service and applies to all content uploaded, posted, or otherwise made available through the Caletan platform.
2. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Caletan has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. Caletan may also, at its sole discretion, limit access to the platform or terminate the account of any user who infringes the intellectual property rights of others, whether or not there is any repeat infringement.
3. Filing a Notice of Copyright Infringement
If you are a copyright owner or authorized to act on behalf of one, and you believe that content available through the Caletan platform infringes your copyright, you may submit a written notification to our Designated Agent (identified in Section 4 below) containing all of the following elements required by 17 U.S.C. Section 512(c)(3):
Physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest that is allegedly infringed.
Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Caletan to locate the material.
Contact information reasonably sufficient to permit Caletan to contact you, such as an address, telephone number, and email address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
4. Designated Agent
Notices of claimed copyright infringement should be directed to Caletan's Designated Agent:
Reservita Inc. Attn: Copyright Agent [email protected]
Ontario, Canada
Upon receipt of a valid DMCA notification, Caletan will act expeditiously to remove or disable access to the allegedly infringing material.
5. Counter-Notification
If you believe that material you posted on the platform was removed or access to it was disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our Designated Agent containing all of the following:
Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Caletan may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Upon receipt of a valid counter-notification, Caletan will promptly forward a copy to the original complainant. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within 10 business days, Caletan may restore the removed material or cease disabling access to it.
6. Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
Before filing a DMCA notice or counter-notification, you should consider whether the use of the copyrighted material at issue constitutes fair use. If you are unsure whether the material you are reporting infringes your copyright, or whether the material you posted constitutes fair use, you may wish to seek legal counsel before submitting a notice.
